Welcome to Dave’s Charity Ball & Gala Dinner website ("the Website"). By accessing or using this website, you agree to comply with and be bound by the following terms and conditions. Please read them carefully. If you do not agree to these terms, you should not use the website.
1. General
1.1 These Terms & Conditions govern your use of the Website and participation in Dave’s Charity Ball & Gala Dinner ("the event").
1.2 Dave’s Charity Ball & Gala Dinner reserves the right to update or amend these Terms & Conditions at any time without prior notice. Your continued use of the website constitutes acceptance of the revised terms.
2. Event Participation
2.1 All ticket purchases, sponsorship's, and donations are subject to availability and confirmation.
2.2 By purchasing tickets or participating in sponsorship opportunities, you agree to provide accurate and up-to-date information.
2.3 Attendees must comply with our Code of Conduct, including appropriate behaviour, respect for other attendees, and adherence to venue rules.
2.4 Dave’s Charity Ball & Gala Dinner reserves the right to refuse entry or participation to anyone violating these terms or acting inappropriately at the event.
2.5 By purchasing tickets or participating in sponsorship opportunities, you agree that you, along with all of your guests, are aged 18 and over.
3. Ticketing and Payments
3.1 All ticket sales and sponsorship payments are final. Refunds will only be provided in exceptional circumstances at the discretion of the event organisers.
3.2 Tickets are non-transferable unless expressly agreed upon by the event organisers.
3.3 Full payment is required at the time of booking. If payment is not completed, your booking will not be processed or accepted.
3.4 All payments are processed securely through PayPal. By using this website, you agree to PayPal handling your payment.
3.5 A PayPal Account is not required to complete your payment unless you are using a mobile device.
3.6 We do not recieve or store any of your payment details, as all transactions are managed directly by PayPal.
4. Auction
4.1 Auction
4.1.1 The auction operated during our event is for the benefit of the Charity for whom the auction is being run.
4.1.2 A number of items offered for sale during the auction (“items”), are subject to a reserve. All monies paid by a winning bidder, and above the reserve price, will be donated to the Charity.
4.1.3 Bidders may bid for more than one item in the auction.
4.4 The winning bidder on each item offered for sale in the course of the auction will be the person who has submitted the highest bid at the deadline and is in excess of any reserve.
4.2 Eligible Bidders
4.2.1 All bidders must be capable of forming legally binding relations under applicable law. Bidding cannot be made by Individuals under the age of 18 and by any other persons who are legally prohibited from, or otherwise incapable of, entering into binding contracts.
4.2.2 Any bidder that places a bid is warranting by so doing that they are legally entitled to do so.
4.2.3 As a bidder you agree that we can process your personal data for the purpose and specifically for this auction.
4.2.4 We do not and will not store your credit or debit card details beyond taking payment during this auction.
4.3 Bidding
4.3.1 Bidders wishing to bid on an item may make a bid for an item by clearly raising their arm during the auction and acknowledging the auctioneer.
4.3.2 All items offered in an auction are listed and offered for sale on an "as is" basis. Bidders are advised to conduct any research or due diligence on an item prior to making a bid.
4.3.3 A bid made by a bidder is an offer to purchase the item listed at the stated bid price. Any bidder making a bid for an item acknowledges and agrees that their offer is an irrevocable offer to complete the transaction if they are the winning bidder whereupon the bid will become a contractually binding obligation to purchase the item at the bid price.
4.3.4 If a bidder bids on an item and that bid represents the winning bid for that item and the winning bid is above or equal to the reserve, the bidder's bid is deemed accepted.
4.3.5 The 'winning bidder' is the person certified by Dave's Charity Ball & Gala Dinner at the end of the auction to be the highest bidder, provided that their bid meets the reserve. The winning bidder may include any under-bidder who is awarded the item.
4.3.6 We, Dave's Charity Ball & Gala Dinner, will not retain your payment records. Our payment processor(s) may retain your details as per their terms and conditions and please see their website for more information.
4.3.7 If Dave's Charity Ball & Gala Dinner has not received payment from the winning bidder after a reasonable period of time, such time to be determined by us in our absolute discretion, then we reserve the right to award the prize to the next highest bidder or another in its absolute discretion.
4.4 Auction Items and Descriptions
4.4.1 Items for sale in the auction are listed in the event programme with a description. A minimum bid will be announced by the auctioneer at the start of the bidding for each item that has a reserve.
4.4.2 The item is offered for sale by Dave's Charity Ball & Gala Dinner on the basis that it is raising money for a good cause.
4.4.3 Dave's Charity Ball & Gala Dinner will, wherever possible, provide a representational image of the item offered for sale in the auction but shall have no liability if it does not do so.
4.4.4 All images are subject to copyright of the image owner.
4.4.5 Whilst Dave's Charity Ball & Gala Dinner strives to ensure that descriptions and photographs are accurate, complete and up-to-date, we do not guarantee that this is the case, and will not be responsible for any damage or loss caused due to a bidder by reason of a description of an item being inaccurate, incomplete or for the item being otherwise in any way different to the bidder's expectation. Descriptions of items are provided without a warranty of any kind.
4.4.6 While every effort is made by Dave's Charity Ball & Gala Dinner to ensure that the item, including any experience or otherwise, works and is in good order and is capable of fulfilment and provides what you would reasonably expect, you acknowledge that the items by definition are marketed as money can’t buy items and as such they come with a significant risk attached and that risk is that they may not be as you expect or they may for some reason become impossible to provide or fulfil; in this scenario, or in any scenario, Dave's Charity Ball & Gala Dinner will not and cannot provide any refund and the bidder agrees to not receiving any refund, without exception.
4.4.7 Some items may have a redemption period within which you must redeem the item and some will also have a date by which you must take up the item. If you do not redeem the item in time or take it up in time, you agree that you forfeit that item and as per the above you will receive no refund.
4.4.8 In redeeming some items, you will be agreeing to the terms of an approved supplier of that item and such terms will be clear for you to accept or reject at that time.
4.4.9 In no way shall Dave's Charity Ball & Gala Dinner (including, its employees, affiliates and volunteers) be liable for any claim, demand or damages arising out of or in any way connected with the auction or bidder’s purchase of an item.
4.5 Bidding Deadlines
4.5.1 Deadlines for receipt of bids made for an item offered in the auction are at the sole discretion of Dave's Charity Ball & Gala Dinner and will not normally be extended under any circumstances. No bids will be accepted on an item after the deadline.
4.5.2 After the auction closes Dave's Charity Ball & Gala Dinner will contact the winning bidder to inform the bidder that their bid was the highest and that they are, therefore, the winning bidder.
5. Sponsorship Terms
5.1 Sponsorship benefits are as outlined in the agreement or package selected. Dave’s Charity Ball & Gala Dinner reserves the right to amend the benefits in case of unforeseen circumstances.
5.2 Sponsors are responsible for providing all required materials (e.g. logos, advertisements) within the deadlines specified by Dave's Charity Ball & Gala Dinner.
5.4.3 Sponsorship agreements are non-refundable.
6. Donations
6.1 All donations are non-refundable and will be used to support the charitable purpose of the event.
6.2 Donors may request a receipt for their contribution for tax or record-keeping purposes.
7. Website Use
7.1 The website content, including text, images, and logos, are the property of Dave’s Charity Ball & Gala Dinner and may not be reproduced, distributed, or used without prior written consent. Please note: Some images used on this website are provided by Freepik and are for illustration purposes only.
7.2 The website may contain links to third-party websites. Dave’s Charity Ball & Gala Dinner is not responsible for the content, privacy practices, or terms of use of these external sites.
8. Liability
8.1 Dave’s Charity Ball & Gala Dinner will not be held liable for any loss, damage, or injury incurred by attendees or sponsors unless caused by negligence on the part of the event organisers.
8.2 The event organisers are not responsible for cancellations, delays, or changes caused by unforeseen circumstances, including but not limited to acts of nature, pandemics, or venue-related issues.
9. Privacy Policy
9.1 All personal information collected through the website or during event registration will be handled in accordance with our Privacy Policy.
9.2 Your data will not be shared with third parties without your consent, except as necessary for event logistics or as required by law.
10. Governing Law
10.1 These Terms & Conditions are governed by the laws of the United Kingdom. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
